Unique Platform Unisono

Article XI.265 of the Code of Economic Law provides, among other things, that the King may determine all measures for the administrative simplification of the collection of rights managed by collecting societies, such as the establishment of a single platform or the introduction of a single invoice.
Article 1 of the Royal Decree of May 17, 2019, establishing the detailed rules for the administrative simplification of the collection of copyright and neighboring rights for the public performance of phonograms provides, among other things, that the collecting societies that manage the copyright and neighboring rights on the public performance of phonograms must provide for a single platform for the collection of the aforementioned rights.
In this context, Playright CV, Sabam CV, and SIMIM CV created the single platform Unisono (hereinafter referred to as “Unisono”). The day-to-day management of the single platform Unisono is carried out by Sabam CV.

This Privacy Statement is intended to inform you about the personal data relating to you that:

(acting as data controllers and hereinafter referred to as “We,” “Our” and “Us”) collects, among other things, via the website https://www.unisono.be (hereinafter referred to as the “Website”) and through other means (mailings, emails, telephone contact, exchanges with our sister associations, etc.) , the reason why We collect and process such personal data, on what legal basis, and how We handle personal data that you provide to Us and personal data that We learn about you as a result of this collection by Us. Your use of the Website and your various interactions with Unisono imply your acceptance of this Privacy Statement.
Legal Basis
We process your personal data based on your explicit consent (Article 6(1)(a) of the General Data Protection Regulation, hereinafter referred to as “GDPR”), or based on the necessity for the performance of a contract to which the data subject is a party (Article 6(1)(b) of the GDPR), or based on the necessity of the processing for the performance of our task in the public interest (Article 6(1)(e) of the GDPR).
When the processing of your personal data is based on your consent, you have the right to withdraw this consent at any time, without affecting the lawfulness of such processing prior to the withdrawal of consent.

We collect personal data about you in various ways (hereinafter referred to as “Personal Data”):

This Personal Data must be provided to enable Us to carry out the processing as described below. This Personal Data includes identification details: your first and last name, password, date of birth or age, place of birth, gender, nationality, national identification number, language, personal or professional address, personal or professional email address, personal or professional mobile or other phone number, the contact details of the person to whom you grant power of attorney, your activity, your profession; your data related to the bank account and e-account; your data as an event organizer; your data related to the works: title, first and last names of the rights holders, first and last names of the performers; billing information: billing address, customers’ VAT numbers, bank account; your messages, or other personal data or contact information you provide to Us. We may also ask for your comments, suggestions, or other information regarding the Website, Our services, or Our businesses. Other specific types of information may be requested in connection with contests, sweepstakes, or other marketing activities, including the uploading of text, video, or audio content.

Use of Personal Data
Your Personal Data will be used solely to the extent necessary to enable Us, within the framework of our statutory and legal mandates to collect and distribute copyright and related rights as collecting societies, to:

grant licensing rights and collect copyright and related rights for the use of the repertoire of PlayRight, Sabam, and/or SIMIM, (Article XI.265 of Book XI “Intellectual Property” of the Code of Economic Law – Articles 1 to 3 of the Royal Decree of May 17, 2019 – Article 6(1)(a), (b), and (e) of the GDPR);

to provide the data subjects or authorized persons and the other relevant collecting societies with the financial settlement data relating to the works in the national and international repertoire of PlayRight, Sabam, and/or SIMIM (Articles XI.252; XI.260, XI.269, and XI.270 of Book XI “Intellectual Property” of the Economic Law Code – Article 6(1)(a), (b), and (e) of the GDPR);

to process your data in the context of managing statutory licenses (Articles XI.229 through XI.245 of Book XI “Intellectual Property” of the Economic Law Code – Article 6(1)(a), (b), and (e) of the GDPR);

to process reports related to the performance of works from the Sabam, PlayRight, and SIMIM repertoires (Article 6(1)(a), (b), and (e) of the GDPR). The notification enables Unisono to verify the list of performed works and thus correctly distribute the collected royalties to the rights holders of the protected works that were performed;

to respond to your direct request, as described at the time we collect your Personal Data or as otherwise described to you prior to the use of your Personal Data (Article 6(1)(a), (b), and (e) of the GDPR);

to manage your use of the Website, including to improve the content of our website and, if necessary, to contact you regarding the unique Unisono platform (Article 6(1)(a) and (e) of the GDPR);

We may combine the Personal Data you provide with other personal data we have obtained about you from other sources for the same purposes, even if you have provided your information to us in other places or via another medium (such as social media channels). These sources include: databases, business cards, SIS, the Verint and Norriq systems, social networks (Facebook, Twitter, LinkedIn, YouTube, Instagram, Google+), Hubspot, Outlook, the databases of Roularta and Graydon, the web crawling system, the websites, event organizers, Sabam’s servers, the playlists of radio stations and concerts, customers, representatives, the Crossroads Bank for Enterprises, Oracle Finance, and the data subjects.
We may not use your Personal Data for new purposes not previously provided for in this Privacy Statement, except on the basis of applicable legal authorization. In any case, We will inform you of any such change to this Privacy Statement before We use Personal Data for other purposes. In the case of consent-based activities, We will not process your Personal Data for such new purposes without first obtaining your consent.
Special categories of personal data
We will not collect or process any special categories of personal data relating to you. Special categories of Personal Data include data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or other similar beliefs, trade union membership, genetic data, biometric data for the purpose of identifying a natural person, health, sex life, or sexual orientation.
Direct Marketing
We will not use your Personal Data for direct marketing purposes without your explicit prior consent, except where permitted under applicable law.
If at any time you decide not to receive commercial or promotional information from Us, you may opt out of direct marketing campaigns free of charge and without providing a reason, and you may object to the future processing of your Personal Data for such purposes by sending Us an email via info@unisono.be and including “opt-out” in the subject line of your email. You may also use the opt-out procedure provided in any promotional message you receive from Us.
Please note: unsubscribing from receiving promotional messages from Us does not prevent you from receiving information related to a contract you may have entered into with Us.
Automated Decision-Making
We will not use automated decision-making processes, including profiling, except where permitted by applicable law. In that case, We will inform you of the logic of the decision and the significance and intended consequences of such processing for you.
Sharing and transferring personal data to third countries
In principle, we do not make your Personal Data available to third parties or disclose it publicly, unless such processing or transfer is based on your specific consent, is necessary for the performance of a contract between you and Us, or when such processing or transfer is otherwise permitted or required under applicable law or pursuant to an order from a competent government or judicial authority.
In the context of our legal and statutory mandate to collect, manage, and distribute copyright and related rights, we may disclose your Personal Data to the following categories of recipients: affiliates, partners, and sister associations with whom representation agreements have been concluded, hosting providers, suppliers, subcontractors, and other service providers (such as service providers specializing in the printing and mailing of letters or email campaigns), contractors under framework or general agreements, government agencies, tax and social security administrations, supervisory and regulatory bodies (such as the audit department of the management companies), lawyers, bailiffs, advisors, accountants, statutory auditors, banks, and financial institutions, etc.
In addition, we may, exclusively in the context of our communication and marketing activities and subject to compliance with applicable data protection laws, share certain (personal) data with external advertising and marketing platforms (such as social media platforms or online advertising networks) for purposes including audience measurement, analysis, or the targeted provision of information and campaigns. In this context, this data is always anonymized or pseudonymized in advance before it is transferred to such platforms, and this processing occurs only if and to the extent that a valid legal basis exists for it (such as your prior consent).
